Internet Betting

1 INTRODUCTION

1.1 These terms and conditions govern your, the player’s (the "Player" or "You") use of the Internet games (the "Internet Games") available at www.supercasino.com (the "Website") and your relationship with Netplay TV Services Ltd ("Netplay"), who provide the Internet Games.

1.2 Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these terms and conditions, you will not be able to register for, or use, the Internet Games. 1.3 Each game is produced by NetPlay TV Services Ltd of Battersea Studios, 80 Silverthorne Road, Battersea, London, SW8 3HE. NetPlay TV Services Ltd are licensed and regulated by the Gambling Commission, License No. 000-003011-R-104180-001.

1.4 By playing the Internet Games you agree to be bound by these terms and conditions.

2 CHANGES TO THESE TERMS AND CONDITIONS

2.1 Netplay reserves the right to amend these terms and conditions. However, Netplay will ensure that the Player is notified of such amendment and that their consent to the amendment is requested the first time that they access their Account subsequent to any amendment. If the Player does not agree to the amendment of these terms and conditions, they will not be permitted to continue using the Internet Games

2.2 It remains the Player’s responsibility to periodically check the terms and conditions to ensure that they continue to agree with them and Players are advised to check these terms and conditions each time they use the Internet Games. Any bet received (but not settled) prior to the time of amendment and notification of amended terms and conditions will be subject to the pre-existing terms and conditions.

3 REGISTRATION AND ACCOUNT USE

3.1 A Player must first register on the Website in order to play our games. To "Play for Real" a Player must register and deposit to their account using a credit or debit card, with a minimum deposit of £20. Registration is only available to persons aged 18 or over and is subject always to the previous and on-going compliance with these terms and conditions. Registered Players may wager up to the amount available in their Account.

3.2 The Player agrees to provide accurate information to Netplay on registration and it is the Player’s responsibility to ensure that their personal details are kept up-to-date via our customer service department, especially address, telephone number and payment/bank details. The Player authorises Netplay to use any lawful means that it considers necessary to verify the information provided by the Player on registration, by means of electronic identity checks in accordance with Anti-Money Laundering Regulations.

3.3 The Account will be used by the Player only. Netplay reserves the right to decline account opening for any reason. The Account is intended for administering the Player's funds, play and fees, as well as bets, refunds, winning payments, cash-outs and any applicable service fees (all in relation to the Internet Games) for the duration of this agreement.

3.4 A Player may open only one Account. Any additional accounts that are funded may be closed and the deposit amount returned to the Player or all such accounts may be treated as one joint Account, in either case at Netplay’s discretion.

3.5 The Player must select a PlayerName and Password on registration. The PlayerName may be displayed on screen when you bet. Your PlayerName may not be obscene or offensive. It is the Player's responsibility to ensure that they keep such details confidential and the Player shall be fully responsible for any misuse of their Password. In the event that a Player is concerned that their Password has been disclosed to a third party, they should notify Netplay immediately whereupon a new Password may be given. Unless caused by Netplay’s negligence, any unauthorised use of the PlayerName and Password shall be the Players sole responsibility and be deemed as their use.

3.6 Netplay may require the Player to change their Password or Netplay may suspend the Player’s Account if Netplay has reason to believe that there is likely to be a breach of its security policies or misuse of the Internet Games or Website.

3.7 To maintain a high level of security to protect Player funds, Netplay may perform random security checks. The Player hereby accepts that Netplay retains the right to demand additional documentation from them in order to verify the Player as the Account holder or cardholder in the event of such a security check. In particular, as part of our standard procedure we may ask players, who have deposited or withdrawn more than £1000, for photographic identification and/or proof of them being the cardholder. Any pending withdrawals may be withheld until the additional documentation has been received by Netplay.

3.8 Player’s accounts are limited to a maximum of £25,000 in net winnings generated within any one calendar month, i.e.: the total amount won over and above the total deposits made. Should a player win in excess of £25,000 within a single calendar month their account may be temporarily suspended until the beginning of the next month. Player’s whose accounts have been suspended in this way may need to produce photographic identification and/or proof of them being the cardholder to re-instate the account.

3.9 The Player should check their Account balance each time they access the Internet Games. In the event of any errors, it is the Player’s responsibility to notify Netplay at the earliest opportunity.

3.10 The Player will inform Netplay as soon as reasonably possible if they believe that their Account information is being misused in any way by a third party so that Netplay may suspend their Account. Netplay will not be held responsible for any reasonable delay in such suspension. The Player will not allow any other person or third party (including, without limitation, any minor) to use their Account or accept any prize on their behalf.

3.11 Netplay reserves the right, upon providing notice to the Player, to close the Player's Account and refund the balance of their Account at its reasonable discretion without further explanation.

3.12 The Player may withdraw money from their Account at any time provided that their balance has been confirmed. Netplay reserves the right to temporarily withhold any withdrawals from a given account in the event of any fraud, money-laundering or ID investigations. Withdrawals are processed after a minimum of three (3) working days after the request is made, during which time the Player may cancel their withdrawal request and place the funds back to their account balance.

3.13 The Player may cancel their Account at any time by informing Netplay in writing at Supercasino, NetPlay TV Services Ltd, PO Box 58140, London, SW8 3UU, or by calling our customer service department on 020 7819 9121, Mon-Fri, 9am-6.00pm. If the Player does so, they must stop using the Internet Games.

3.14 If an account remains dormant, i.e.: where there are no bets placed or deposits made, for a period of twelve (12) months or more Netplay reserves the right to charge a £10 monthly administration fee from the remaining balance on the account, or the full balance where it is less than £10 in order to keep the account open and reserved for the Player. Players will be informed by email by Netplay in advance of this charge being made, giving the Player seven (7) days to return and use the account again before any charges begin. This charge will be taken from the balance on the last working day of each month, until the player either makes a bet, makes a deposit to the account, or the balance of the account has expired, whereupon the account will be closed.

3.15 Netplay or the Player may suspend or cancel the Player’s Account immediately if the other breaches any of its obligations under these terms and conditions. Return of any outstanding balance to the Player will be subject to the provisions of these terms and conditions. The suspension or cancellation of the Player's Account shall not affect either party's statutory rights or liabilities.

3.16 Employees of NetPlay and any associated company are not eligible to participate in the Internet Games.

4 AVAILABILITY AND USE OF THE INTERNET GAMES

4.1 Participation in the Internet Games is only possible during the hours of broadcast of the TV show relating to the Internet Games (the "Show").

4.2 When playing online you place bets using the on-screen games tables. Once you have placed your bets you are required to click the confirmation button. At any time you can click the cancel button to return to the games table to change or alter your bets. ONCE YOU CLICK THE FINAL CONFIRMATION BUTTON AND YOUR BETS ARE ACCEPTED THEY CANNOT BE CANCELLED.

4.3 When playing online you understand that you must listen at all times to the audio streamed as part of the live feed of the televised show in order to listen to important announcements that could affect your gameplay and/or the outcome of individual games.

4.4 When playing online you understand that the live feed streamed to your computer is subject to latency caused by Internet transfer protocols. As such, events may be seen within the gaming screen before they can be seen within the live stream. This does not affect your eligibility to bet in any way, nor your chances of winning.

4.5 The payout rates on each game can be found in the respective game rules.

4.6 To place a bet you must have sufficient credit in your account. If you do not have sufficient credit to cover all your bets then your bets will not be placed at all. When playing online your balance is constantly shown on-screen within the gaming page.

4.7 Your bet may not exceed the bet limit in force in relation to each game. Each game has different bet limits - for those limits see the individual game rules.

4.8 Your bet will not be accepted unless the game is in the state to accept your bet.

4.9 Players MUST make the final confirmation of their bets online by clicking the confirmation button and must see the "Confirmed" message. Otherwise the bets are not deemed confirmed. The "Confirmed" message is returned by our Games betting server once the bets have been entered into the central database and NOT before. Should a "Confirmed" message appear a user should be able to see the bets in their bet history once the game has closed and a new game began. However, Internet connections between the Internet Games and our players are also dependant upon the integrity and performance of the Player's own Internet connection via their Internet Service Provider. Netplay can offer no guarantees as to the performance of a Player's Internet connection and Players must recognise that data transfer errors can occur outside of our control. All entries in a player's bet history will be deemed confirmed and final by Netplay rules. Should a player wish to dispute an Internet bet that they feel is contrary to these rules then please email complaints@supercasino.com.

5 PLAYER REPRESENTATIONS

5.1 The Player is over the age of 18 and has the mental capacity to take responsibility for their own actions. Netplay reserves the right to void any transactions involving minors. The Player confirms that he/she is aware that underage gambling is a criminal offence.

5.2 The Player understands that by using the Internet Games they may lose money on bets placed and they accept full responsibility for such loss. The Player also agrees that their use of the Website is at their sole risk.

5.3 The Player warrants that they will not attempt to hack, make unauthorised alterations to or introduce any kind of malicious code to the Internet Gaming Service or Website. As such, the Player will not, without limitation, (a) reverse engineer or decompile (in whole or in part) any software available through the Website; or (b) make copies, modify, reproduce, transmit, alter or distribute all or any part of the Website or any material or information contained on it.

5.4 The Player must not use any form of computerized assistance in calculating risk strategies or bet placements of any kind, nor to predict the outcome of any betting or wagering event. Any such action will be considered to be cheating, which is a criminal offence. Players engaging in this type of activity will forfeit any winnings accrued through the use of the Internet Games and the appropriate authorities will be notified.

5.5 The Player agrees that Netplay may lock or terminate a Player’s Account if:
- a Player breaches these terms and conditions;
- a Player's funds are insufficient for the proposed use of the Internet Games;
- Netplay has reason to believe that the Player's dealings with Netplay constitutes an illegal or fraudulent activity, Netplay shall not (to the extent permitted by law) be liable to that Player for any such deposits, nor shall it incur any liability to any Player where it is required to give information or documentation relating to that Player to any relevant regulatory authority;
- Netplay suspects that access to the Account may not be by an authorised person;
- legal or regulatory requirements require such locking or termination; or
- a security, disrepute or other issue deemed reasonably significant by Netplay arises.

5.6 These terms and conditions contain the entire agreement between the Player and Netplay relating to the Internet Games. The Player confirms that, in agreeing to accept these terms and conditions, they have not relied on any representation save insofar as the same has expressly been made a representation in these terms and conditions. The Player agrees that they shall have no remedy in respect of any misrepresentation that has not become a term of these terms and conditions save that their agreement shall not apply in respect of any fraudulent or negligent misrepresentation whether or not such term has become a term of these terms and conditions.

6 PAYMENT AND SECURITY

6.1 Money in a Player’s Account is used to place bets on the Internet Games. Netplay reserve the right to refuse or limit any wager. Players are not allowed to place a wager greater than the amount deposited in their Account. Any winnings are placed into their personal Account. Deposits and withdrawals are made through the Internet Games customer service department, or via the "My Account" section of the SuperCasino website.

6.2 The maximum single deposit is £3,000. Credit card deposits are limited to a maximum of £10,000 in any calendar month. There is no limit on deposits made by debit card, bank transfers, cheques or postal orders.

6.3 You can make a deposit using a debit or credit card including Visa, Visa Delta (Debit), Visa Electron, Solo, Mastercard and Maestro (formerly known as Switch). We do not accept American Express. Please note that the card must be in your name (the registered Username) and registered to the same address provided when you open your account with us.

6.4 You can top up your account by accessing the "My Account" section of the site and following the online prompts. Please note that the card must be in the name of the registered player and registered to the same address provided when you open your account with us.

6.5 All bets stand and no bet can be cancelled once confirmed by Netplay.

6.6 A player may suspend their Account at any time. A suspended Account means that funds can temporarily not be used for gaming. The decision to suspend an Account is taken by the player.

6.7 The funds on the Player's Account are available for the Player during the opening hours of the Website. Upon request by the player, Netplay will action a payment by cheque or to the player's bank account of part or whole of the player's funds at the time of the transfer request, with deductions for eventual service fees, bank fees etc. All cheques issued are valid for a maximum of 6 months from the date of issue, after which time they will be cancelled if they remain uncashed by the Player.

6.8 Customer funds are administered through separate bank accounts and are fully segregated from company funds. The protection of those funds is based upon the internal controls of the company

7 NO WARRANTY

7.1 Netplay will endeavour to provide the Internet Games using its reasonable skill and care. Save where required by law, Netplay makes no warranty or representation, whether express or implied, in relation to the Internet Games.

7.2 Netplay makes no warranty that the Internet Games will meet the Player’s requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Internet Games or the server that makes it available are free of viruses or bugs, nor do Netplay make any warranty as to the full functionality, accuracy, reliability of the materials supplied by Netplay or results of the Internet Games or the accuracy of any information obtained by the Player through the Internet Games. Please see the individual game FAQ’s for any known technical factors that could affect the outcome of a game.

7.3 The Player’s access to the Internet Games may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. In this event, Netplay will attempt to restore the service as soon as it reasonably can.

8 CHARGEBACKS

8.1 If you notify your card supplier of unauthorized use of your card or there is any other circumstance leading to a "chargeback" and SuperCasino is asked to refund the amount, SuperCasino will suspend your Account and ask you to contact SuperCasino Customer Services. SuperCasino reserves the right to debit your Wallet with the chargeback or to recover the amount from you if there are insufficient funds in your Wallet. You agree to pay this sum promptly if properly required by us. You will not be allowed to participate in further Games until the chargeback has been successfully resolved.

9 NETPLAY CONDUCT AND LIMITATION OF LIABILITY

9.1 The Player agrees that their use of the Internet Games is at their sole risk.

9.2 Netplay shall not be responsible or liable to the Player for any loss of content or material uploaded or transmitted through the Internet Games and the Player confirms that Netplay will not be liable to the Player or any third party for any modification to, suspension of or discontinuance of the Internet Games.

9.3 Netplay reserves the right to withdraw the Internet Games or elements of the Internet Games at any time, and will not be liable to the Player as a result of any such action.

9.4 Netplay will not be held responsible for any typing, technical, or human error in the operation of the Internet Games. In the event of error, Netplay reserves the right to either void any affected bets or to correct the error.

9.5 We may notify you of changes to, or of important matters relevant to, the Games, by email. Such notices will be deemed effective if transmitted to the email address you have provided to us on registration (subject to changes of address you notify us of).

9.6 Netplay will under no circumstances be held liable for any damages or losses of an indirect nature that are deemed or alleged to have resulted from or been caused by the Internet Games, the Website or its content including, without limitation, delays or interruptions in operation or transmission, communication line failure, any persons use or misuse of the Website or its content, any errors or omissions in content, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary or consequential loss.

9.7 Netplay will not be responsible for any breach of these terms and conditions caused by circumstances beyond its reasonable control.

9.8 Netplay’s liability under 9.6 above shall be limited to the commission received by Netplay in respect of the bet or bets which are the subject of any breach by Netplay.

9.9 Netplay does not exclude or limit liability for death or personal injury caused by negligence or for fraud.

9.10 Netplay reserves the right to withdraw the Website, the Internet Games or elements of either at any time, and save for any rights that the Player may have over deposited funds in its Account, will not be liable to the Player as a result of any such action.

10 SOCIALLY RESPONSIBLE GAMBLING

10.1 A Player may at any time apply to exclude themselves from participating in Telephone Casino Games. If a Player wishes to do so, he/she should contact customer services on 0800 1984 777 during the show’s hours, or on 020 7819 9121 Mon-Fri, 9am-6pm. Alternatively a player may self-exclude using the online facility available on the website.

10.2 In line with UK gambling regulations, Players may, by written notice to Netplay, place a limit on their gambling activity. If a Player wishes to limit their gambling activities at any time, he/she should contact customer services on 0800 1984 777 during the show’s hours, or on 020 7819 9121 Mon-Fri, 9am-6pm. Alternatively a player may set or reduce a limit using the online facility available on the website.

11 FRAUDULENT AND ILLEGAL USE OF THE WEBSITE OR THE INTERNET GAMES

11.1 If Netplay has reason to believe that the Player’s dealings with Netplay constitutes an illegal or fraudulent activity and to the extent permitted by law, Netplay shall not be liable to that Player for any such deposits, nor shall it incur any liability to any Player where it is required to give information or documentation relating to that Player to any relevant regulatory authority.

12 TRANSFER

12.1 The Player may not transfer any of their rights under these terms and conditions to any other person. Netplay may transfer its rights under these terms and conditions to another business where it reasonably believes that its rights will not be affected.

13 THIRD PARTY RIGHTS

13.1 Except insofar as these terms and conditions expressly provide that a third party may in their own right enforce a term of these terms and conditions, a person who is not a party to these terms and conditions has no right under local law or statute to rely upon or enforce any term of this agreement.

14 SETTLEMENT OF DISPUTES

14.1 If the Player has any dispute with regard to any outcome in the Internet Games or any other activity, the Player should submit their complaint to Netplay in writing within fourteen (14) days of the incident by email to complaints@supercasino.com or by post to SuperCasino, NetPlay TV Services Ltd, PO Box 58140, London, SW8 3UU. If the parties cannot agree a resolution to any dispute with twenty one (21) days of the receipt of the complaint by Netplay, the dispute will be referred to an independent dispute resolution body such as IBAS.

15 NOTICES

15.1 The Player may submit notices to Netplay in writing at: SuperCasino, NetPlay TV Services Ltd, PO Box 58140, London, SW8 3UU. Any notice Netplay gives to the Player (save as otherwise set out herein) will be sent to the email address that the Player provided when the Player registered their Account.

16 GENERAL

16.1 If any part of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these terms and conditions and shall not affect the validity and enforceability of any of the remaining provisions of these terms and conditions.

16.2 No waiver by Netplay of any of these terms and conditions shall be construed as a waiver of any preceding or succeeding breach of any of these terms and conditions.

16.3 Nothing in these terms and conditions shall be construed as creating any agency, partnership or any other form of joint enterprise between the Player and Netplay.

16.4 The Player confirms that they have read, understood and accept the Netplay privacy policy.

16.5 The Internet Games is subject to the laws of England and any dispute arising out of or relating to the Internet Games shall be governed by the laws of England.
